Terms & Conditions of Auction

 

Buyers Premium: 10% on the balance to be capped at $3500

Buyers premium may change for different auctions, please check terms for each auction.

 

Farris Auctions will conduct the sale of items ("Items") either individually or in groups ("Lot") through Auction ("The Auction")

Each Bidder Number/Username is unique and cannot be transferred.

Bidders are responsible for any bid placed with their Bidder Number.

State Sales Tax will be applied to all Lots unless Bidder provides valid proof of tax exemption status and acceptable exemption certificates for Their state.

The highest bidder for each lot will be the Purchaser.  In the event of a dispute Farris Auctions reserves the right to settle the dispute or re-offer the lot for sale.  Farris Auctions is not liable for any loss or damage from Lots not presented for sale.

Full Payment must be made directly to the auctioneer/seller in ACH, Cash, Cashiers Check, or Wire Transfer within 3 days!! NO EXCEPTIONS!!!

For bidders who do not pay by the 3 day period, these bidders will be considered slow to pay and Farris Auctions reserves the right to ban that bidder from bidding at any future auctions.

No Items will be removed from premises until Invoice is paid in FULL!

All items must be removed from premises within 14 days of the close of the auction.  

Failure to remove items by the allotted time will result in storage fees and possible transportation fees.

Farris Auctions will make every effort to ensure all Lots listed in the catalog for sale ("Catalog")  are available at the auction.  Farris Auctions accepts no liability for any loss or damage, including costs of attendance, from any Lots not presented for sale.

Descriptions of the Lot(s) in the catalog are based on information provided by the Seller(s) and are to the best of Farris Auctions' knowledge and belief.  Farris Auctions is not liable for any faults, deficiencies, or errors of any kind, whether oral or printed. They do not guarantee the authenticity, genuineness, origin, age, condition, or quality of any of the Lot(s).  All statements regarding these matters are opinions and not representations of fact. Farris Auctions reserves the right to bid on behalf of the Consignor. Prospective Purchasers must verify the correctness of each statement through inspection or other means.

Each Lot is sold "as-is, where-is." Farris Auctions provides no guarantees or warranties (express or implied) regarding the items in the Lot.

All representations made by Farris Auctions, its employees, or agents is considered an opinions, and Farris Auctions accepts no liability for any purchase made by a Buyer relying on them.

The Buyer/Purchaser of a Lot is deemed to have inspected the item in that Lot and found it satisfactory prior to purchase.

Upon receipt of cleared funds from the Buyer/Purchaser, Buyer/Purchaser agrees to remove item from its location as soon as possible, unless otherwise agreed to in writing by Farris Auctions

The Buyer agrees to insure the Item purchased against all losses from the Auction Date until the removal of the item by the Buyer. Buyer/Purchaser acknowledges they have read, agree, and are bound by these terms by registering for the auction. 

Farris Auctions is not responsible for the condition cosmetic or mechanical of any item(s) left on its lot before or after the auction.

All sales are final upon removal of the item!

Any Claim for misdescription must be made prior to the removal of the property and withing 3 business days of the auctions end.  If Farris Auctions confirms the item does not conform to its description, they will retain the property and refund any money paid.  The seller's liability shall not exceed the actual purchase price of the property. 

 

If you are the winning bidder and fail to adhere to any of these terms & conditions, your account with Farris Auctions will be locked!
